1. About these terms
These terms form a contract between you and Copywatch, which operates Copywatch (“we”, “us” or “our”), when you create an account, buy a subscription or use the service. If you use Copywatch for a business or organisation, you confirm that you have authority to bind it. You must be at least 18.
Our Privacy Policy explains how we handle personal data. If you do not agree to these terms, do not use Copywatch.
2. What Copywatch provides
Copywatch imports public Shopify catalogue information, runs visual and product-name searches, surfaces possible similarities, organises your review and can help draft a removal or clarification request for you to edit and send. Features, search sources and limits vary by plan and may change as the service develops.
Copywatch is an investigation and workflow tool. A similarity result is a lead, not proof of copying, ownership or infringement. We do not provide legal advice, make legal decisions, contact a listing owner automatically, guarantee complete search coverage or promise that content will be removed. You remain responsible for checking each result and deciding what action is accurate, proportionate and lawful.
3. Your account
You must provide accurate information, keep access to your email secure and notify us promptly of suspected unauthorised use. Magic links and other account access methods are personal to you. You are responsible for activity carried out through your account unless caused by our failure to use reasonable care.
4. Stores, content and permissions
You may connect only stores and catalogues you own or are authorised to manage. You keep ownership of information and original material you submit. You give us a limited, worldwide licence to host, copy, analyse and process that material only as needed to provide, secure and improve the service.
You confirm that you have the rights and lawful basis needed to provide any personal data, images, notes or contact details you add. Do not upload confidential or sensitive material that is not necessary for the service.
5. Acceptable use
You must not:
- use Copywatch to harass, threaten, defame, mislead or make knowingly false claims;
- submit a removal request without a good-faith basis or present an unverified match as conclusive proof;
- connect a store, use content or process personal data without appropriate authority;
- probe, disrupt, overload, scrape or bypass the service, its security or plan limits;
- reverse engineer the service except where the law expressly permits it; or
- use Copywatch in breach of intellectual-property, privacy, consumer-protection, sanctions, export-control or other applicable law.
6. Subscriptions, payment and cancellation
Prices, currencies, billing periods and plan limits are shown before checkout. Stripe processes payment. Subscriptions renew automatically for the same billing period until cancelled. You can manage or cancel your subscription through the billing portal; cancellation takes effect at the end of the paid period unless stated otherwise.
Fees already paid are non-refundable except where required by law or expressly agreed by us. Taxes may apply. If payment fails or a subscription becomes inactive, we may pause monitoring and paid features. We will give reasonable notice of a price change that affects a future renewal.
7. Search and AI-assisted output
Search coverage depends on third-party indexes, public website access, image quality, provider availability and other factors outside our control. Results may be incomplete, duplicated, outdated or incorrect.
AI-assisted searches and message drafts can make mistakes. You must review and edit every draft before using it, verify names, links, dates and claims, and obtain professional advice where appropriate. You are responsible for the message you choose to send and any consequences of sending it.
8. Our intellectual property
We and our licensors own the service, software, design, branding and documentation, excluding your content and third-party content. We give you a limited, non-exclusive, non-transferable and revocable right to use Copywatch for its intended purpose while your account is active.
If you send feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.
9. Third-party services
Copywatch relies on third-party services for hosting, authentication, billing, email, analytics, search and AI processing, and links to websites we do not control. Their availability and terms may affect the service. We are not responsible for third-party websites or for actions you take on them.
10. Availability and changes
We aim to provide a reliable service but do not promise uninterrupted or error-free operation. We may maintain, change, suspend or discontinue features where reasonably necessary. We will try to give reasonable notice if a material change significantly reduces a paid feature you rely on.
11. Suspension and termination
You may stop using Copywatch and cancel your subscription at any time. We may restrict or suspend access to protect users or the service, investigate suspected misuse, comply with law or respond to a material breach. We may terminate an account for a serious or repeated breach, normally after giving you a reasonable opportunity to put the issue right where appropriate.
On termination, your right to use the service ends. Provisions that by their nature should continue—including ownership, payment obligations, liability limits and dispute terms—will survive.
12. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill or anticipated savings, or for loss caused by an action you take on an unverified result or draft. Our total liability arising from the service in any 12-month period is limited to the greater of £100 and the fees you paid us during that period.
If you use Copywatch as a consumer, your mandatory statutory rights are not affected. The limitations above apply only to the extent permitted by the law that applies to you.
13. Changes to these terms
We may update these terms for legal, security, operational or service reasons. We will post the revised terms and update the effective date. If a material change adversely affects you, we will provide reasonable notice. Continuing to use the service after the change takes effect means you accept the updated terms.
14. General
You may not transfer this contract without our written consent. We may transfer it as part of a reorganisation, financing or sale of the business, provided this does not reduce your rights. If any provision is unenforceable, the rest remains in effect. A delay in enforcing a right is not a waiver. These terms are the entire agreement about your use of Copywatch and do not give rights to anyone else.
15. Governing law and disputes
These terms are governed by UK law, specifically the laws of England and Wales. The courts of England and Wales have jurisdiction, except that if you are a consumer living elsewhere you may also have the benefit of mandatory local law and may be able to bring proceedings in your local courts.
